NC: Firearm Confiscation by Law Enforcement in a Nutshell



The video was filmed at the Moccasin Creek Minutemen meeting on the 2nd amendment in Zebulon, NC on January 17, 2013. Three North Carolina sheriffs  addressed a group of over 200 people who are concerned that the federal government will infringe upon our 2nd amendment rights. The consensus after the meeting is that we are now even more concerned about our right to bear arms. All three sheriffs (Donnie Harrison-Wake County, Jerry Jones-Franklin County and Carey Winders-Wayne County) assured the people that they would not confiscate our firearms. The reason: the federal government will not pass legislation restricting the 2nd amendment.

However, if Congress did pass such legislation, they would enforce the law and we must work through the legal or legislative system to change it. I personally want to extend my appreciation to these sheriffs for meeting with us. I also personally believe that they are all good men. But:

1. It has been said that for evil men to accomplish their purpose it is only necessary that good men should do nothing.


2. Congress will pass legislation that is not supported by the majority of the people as  (Affordable Health Care).

3. Congress will pass legislation without reading (or comprehending it) as Nancy Pelosi pointed out.

4. Marbury v. Madison cited by Sheriff Harrison’s attorney is the legislation that Thomas Jefferson warned us about:

You seem to consider the judges the ultimate arbiters of all constitutional questions; a very dangerous doctrine indeed, and one which would place us under the despotism of an oligarchy. Our judges … and their power [are] the more dangerous as they are in office for life, and are not responsible, as the other functionaries are, to the elective control. The Constitution has erected no such single tribunal, knowing that to whatever hands confided, with the corruptions of time and party, its members would become despots. It has more wisely made all the departments co-equal and co-sovereign within themselves … . When the legislative or executive functionaries act unconstitutionally, they are responsible to the people in their elective capacity. The exemption of the judges from that is quite dangerous enough. I know of no safe depository of the ultimate powers of the society, but the people themselves. …. — Letter to Mr. Jarvis, Sept, 1820.

5. Over 100 people stood outside the meeting room and in the parking lot trying to hear how our sheriffs will act under what we consider unjust laws. Obviously people want to know their position on this issue. I do not consider being told that our federal government will not act to take away our rights as a valid response based on what has already transpired. And I am not alone, based on firearm and ammunition sales.

We have vain and aspiring men in our highest offices and our sheriffs should be our best defense against this tyranny. But they do not see this danger. We need statesmen instead of politicians to save our country. We also need sheriffs who will stand up for the rule of law. If they cannot distinguish between the “rule of law” and the “rule of men”, where does that leave us?

  1. I posted a rare original piece today on this. Basically, the conclusion I came to was that these Sheriffs see themselves as enforcers of government rather than elected representatives of the people. They have given up their power under the Constitution.

  2. They were nervous and on edge , they probably didn't expect the turnout and were feeling overwhelmed. Not very encouraging what I heard. These are career men who will follow orders. W. R .

    1. Maybe some minds can be changed. A friend wrote his sheriff after this and asked him to please explain further due to the uproar. I'll post it hopefully.

  3. That clip could be taken a couple of ways. While the speaker was simply laying out what the law is, I didn't hear any position regarding what he would advocate *doing*. Big difference there. Plus, I appreciate his honesty. My sheriff here would have lied to their faces and smiled while doing it.

  4. Contrast those three bootlickers with Sheriff Richard Mack of Arizona and his organization,the Constitutional Sheriffs and Peace Officer's Association which says,

    "It's Time To Stand And Be Counted
    The Right of Self Defense for all individuals is a God-given unalienable right that precedes our country's foundation and all government institutions. Our Founders believed this right was so vital that they unanimously declared it as part of the Bill of Rights. Their reference to the Militia within the Second Amendment is not a contradiction, as Founding Father George Mason stated, “I ask sir, what is the Militia? It is the whole people. To disarm the people is the best and most effectual way to enslave them.” This principle had nothing to do with hunting or target shooting, but had everything to do with liberty.

    Therefore, in keeping with the Oath we each swore, to protect and defend the United States Constitution, and to do our duty to preserve the rights of the people we work for, we, the Sheriffs of America, do hereby declare and make it known, that we will oppose and disallow, any and all attempts to further erode the rights of the citizens of our counties and parishes. In fine, the rights of the people to keep and bear arms Shall Not Be Infringed.

  6. They knew what the question would be and did not want to touch the fact that all previous laws written violating the Constitution and BOR are void when written illegally.

    4. No problem and I am sure they guessed some of them, but don't think they were prepared for the hostile reactions. As one cop stated elsewhere "Going door to door confiscating weapons is a death wish."
      I wouldn't do it for all the tea in China.

      A member of my network met with the Catawba Sheriff, Cory Reid today to clarify where he stood. My company is in Catawba County but I live in Burke county and I am working on clarification with Burke County. The message I received after the meeting is as follows:


      I had an chance to sit with our Sheriff and pick his brain about the presidential push for gun control.

      Sheriff Reid said " I, or anyone who works for me, will not enforce any laws that are contrary to the 2nd amendment. If any federal, state, or anyone else tries they will stopped by me and my boys."

      Also in speaking with him he stated several other sheriff's both in NC and other states are coming out saying the same thing. He also said that the State Sheriff's association was preparing a letter to send out saying the same thing.

      If O tries to take them he is going to have a hell of a fight!

  7. These Sheriff officers at this meeting managed to turn the temp up another notch. It is obvious they intend to continue to suck the Fed teat at least in the beginning. No one for any amount of payola could give me their job. They sold out the People.
