So now, the next necessary deception in the campaign is to convince you that — all together now — “the system worked.” In reality, the civilian justice system did not work, and that is because it cannot work — not if the objective is the swift acquisition of vital national-defense information.

It could not be more obvious to an objective, rational person that if the aim is intelligence collection, it is far better to interrogate a terrorist without limitations on time and subject matter, without the interference of a defense lawyer, and without empowering the detainee by giving him plea-bargaining leverage to trade for information. The Obama administration, however, is telling you, with a straight face, that the imposition of civilian due process will produce intelligence just as effectively, if not better.

Most people, of course, realize that this is impossible if Miranda warnings must be given. So the administration rolls out canard No. 1: the “public-safety exception.” The public is led to believe that this exception means agents have at least 48 hours of freewheeling interrogation before Miranda kicks in and the terrorist clams up (upon lawyering up). This is brazenly false.

  2. I expect to catch some heat for this but I stand for what I believe. If you believe and support the constitution then you have to for everyone. I fully support the idea that the stooges in Gitmo should not be in American courts. This is different! The bomber is an American Citizen and the crime he committed was in America. All the talk of "National Security" is just that, TALK. Everyone I know is worried the NDAA is an excuse to just arrest anti-government people without any access to the courts.

    We have had bombing in this country almost as long as it has been a country. Other than ol' Honest Abe no one has ever suspended our rights as spelled out in the Constitution. The bombings have been solved in our legal system. So all the calls to strip the bomber of his rights is just wrong to me. Supporting the Constitution when things are good is easy. It is supporting it when everything is going wrong is when it gets hard and is needed the most.

    1. Agreed, we made him an American Citizen. If however that changes then so does his status. I am just irked when those on the right, Sean Hannity comes to mind, that blast our "Dear Leader" for stripping rights. Then want to do exactly the same thing for "THEIR" version of national security. I believe in the strength of the Constitution. Either it applies to all Americans and we have freedom or it only applies to some and we have tyranny. I just believe we need to give it a good feeding from the blood of traitors.

  4. "Naturalized" American Citizen - like the Nazi's that lied after WWII and came to the US and got their citizen stripped then they were deported / sent to Israel for trial for their War Crimes. IMHO Hold special hearing strip him of his citizenship and send him to GITMO- this would be a message to all that come to the US for asylum get citizenship them commit heinous acts.
