Mueller faces ‘unique hurdles’ if he wants to press obstruction case against Trump

Special counsel Robert Mueller could have a tough time making an obstruction of justice case stick against President Trump, according to legal analysts, who said he will have to overcome a number of “unique hurdles” — not the least of which is a decades-old Justice Department ruling that a sitting president can’t be charged.

Analysts say it will be up to Mr. Mueller to decide whether to accept the long-standing opinion of the Office of Legal Counsel, which ruled in 1973 and again in 2000 that a president has immunity from criminal prosecution.

It’s also not clear that FBI investigations count as “proceedings” that could be obstructed under one of the legal statutes that might be cited in an obstruction case, according to a legal memo prepared last month by the Congressional Research Service.

“Courts have not reached consensus on whether an FBI investigation meets this standard,” the report says of 18 U.S.C. 1505, which applies generally to obstruction of administrative proceedings.

So much for defanging the poisonous debate in Washington.

Dozens of congressional staffers erupted into boos, jeers and even vulgar gesticulations Thursday when President Trump appeared in a video at the Congressional Baseball Game at Nationals Park.
Mr. Trump delivered a message of unity, but some fans in the stands weren’t having any of it.

One man shouted an expletive at the video screen as Mr. Trump was telling the fans: “We are showing the world we will not be intimidated by threats.”

The episode marred what had been a night celebrating those wounded in Wednesday’s murderous attack on GOP players practicing for the game.

When both teams went to second base — the symbolic spot where Rep. Steve Scalise was wounded in the attack at the Alexandria practice field — to kneel and pray, some mocked the prayer too. The fans appeared to be Democratic staffers, having booed the announcement of several members of the GOP lineup.

It’s no secret that CNN is no friend of President Donald Trump… but even the left-leaning news network couldn’t skew the facts against the president when a panel of “everyday” Americans showed up.

A group of voters was recently assembled in Ohio following the testimony of James Comey. The nine citizens were asked by CNN National Correspondent Gary Tuchman to respond to several questions, and the result was definitely not what the cable network had planned.

“First thing I want to ask you: It is a crime when you testify before Congress to lie,” Tuchman stated in a clear attempt to “prep” the panel. “That is perjury. You can go to prison for it.”

Eric Schmidt, billionaire chair of Alphabet, Inc. the parent company of Google, led a massive fundraising drive in December for leftist analytics firm Civis Analytics, represented by a law firm that partnered with Justice Department special prosecutor Robert Mueller—raising questions about Mueller’s impartiality in his so-called “Russia probe” into President Donald J. Trump’s campaign.
In March 2014, WilmerHale announced Mueller would join its firm as a partner. Mueller left his position in May after the DOJ appointed him as a special prosecutor to look into alleged “ties” between President Trump’s campaign and Russia. 

WilmerHale represented Civis Analytics during a $22 million fundraising drive Schmidt in part led.
“Partner Peter Buckland and Associate Jessica Wade represented Civis in this transaction,” a Dec. 2016 WilmerHale press release read. Mueller was still a WilmerHale partner at the time.

President Donald Trump and his allies have set their sights on attacking special counsel Robert Mueller in an attempt to paint Mueller as an anti-Trump partisan.

When Mueller, a former FBI director, was first appointed to the role by deputy attorney general Rod Rosenstein, conservatives cheered the decision, saying he would conduct a fair investigation into alleged Russian election interference or go after Trump’s enemies.

“Robert Mueller is superb choice to be special counsel. His reputation is impeccable for honesty and integrity. Media should now calm down,” former House Speaker and Trump ally Newt Gingrich tweeted on May 17.

Conservative commentator and author of “In Trump We Trust: E Pluribus Awesome” Ann Coulter tweeted that same day, “People who have most to worry about with appointment of Special Counsel Robert Mueller: Hillary, Loretta Lynch, John Podesta, Bill Clinton…”

Fast forward a few weeks and Mueller has become an enemy of the White House.

The Confederate battle flag is, as John Coski of the Museum of the Confederacy titled his book on the subject, “America’s most embattled emblem.” Recent polls show that Americans are split down the middle on the flag: half view it as a symbol of heritage, half as a symbol of hatred (and an overwhelming majority are against tearing it down from public places). For all the outraged opinions, however, the true story of the Confederate flag – how it came to be and what it meant to those who made it and bore it – does not fit the narrative.

A Taiwanese company that assembles Apple’s iPhones and other electronics is considering building a plant in Wisconsin that could employ thousands of people and give Gov. Scott Walker a huge political boost as he prepares to run for re-election.

A person with direct knowledge of the negotiations who was not authorized to speak publicly confirmed to the Associated Press on Wednesday that the state is in talks with Foxconn. At least one other upper Midwest state, Michigan, is also pursuing the plant.

President Donald Trump alluded to negotiations with an unspecified company during a visit to the Milwaukee area on Tuesday, saying Walker might get “a very happy surprise very soon.”

Anyone who has been paying attention has heard many times the assertion that the flag of the Southern Confederacy is equivalent to the banner of the Nazi German Reich.  That this idea should gain any credit at all is a sign of how debased American public discourse has become by ignorance, deceit, and hatred.

To make an obvious point:  The Confederacy fought a defensive war against invasion.    It had no design to rule others or exploit their resources—only wished to be let alone.  Nazi Germany was a militarist state, dedicated to a boastful, bullying, brutal conquest of other peoples.  Rather like the U.S. Army in 1861—1865.

Trump favorability rating is rising again

I've updated the favorability chart to include today; now at 47% - about 8% lower than where Obama was in his first presidential term. Trumps' 47% is slightly but not significantly higher than the 46% of votes he received in November, showing his support remains strong with those who voted for him then. 

Obama first fell below 50% favorability shortly after Labor Day in his first year - where he remained
for all but the last months of his eighth and final year.

Rep. Steve King (R-Iowa) linked former President Barack Obama to the attack on Republican lawmakers at a baseball field in Northern Virginia, arguing Obama deepened the nation's political divisions by emphasizing "differences rather than our things that unify us."

That intense political division, King said, is what led a gunman to open fire at a park in Alexandria, Va., on Wednesday, as Republican members of Congress were practicing for a charity baseball game against their Democratic colleagues.

"I do want to put some of this at the feet of Barack Obama," King said on WHO Iowa radio. "He contributed mightily to dividing us. He focused on our differences rather than our things that unify us. And this is some of the fruits of that labor."

Sen. Rand Paul (R-Ky.) sharply criticized central elements of the emerging Senate Republican healthcare bill on Thursday, indicating that he will vote against it unless dramatic changes are made.

Paul denounced as “new entitlements” two core elements of the Republican bill in both the House and Senate: a refundable tax credit to help people buy insurance and a “stabilization fund” of money to help bring down premiums.  

“I think we shouldn't have new entitlements that will go on forever in a Republican plan to fix healthcare,” Paul told a small group of reporters. “We can't pay for what we already have: Medicare, Medicaid and Social Security.”

If you rely on CNN, NBC, CBS, ABC, MSNBC, NPR, the New York Times, and the Washington Post for Foreign Policy news and commentary, you probably don’t yet realize that there are storm clouds gathering in the Persian Gulf.

President Trump recently remarked that the Persian Gulf state of Qatar “has been a funder of terrorism at a very high level….The time has come to call on Qatar to end this funding…and extremist ideology.”

Qatar was also a major contributor to the Clinton Foundation and continues to contribute generously to Muslim brotherhood operations around the world. Qatar is also overtaking Saudi Arabia in funding the construction of mosques in the U.S. and Canada and funding Islamic and religious studies departments in American, Canadian, and British educational institutions. Qatar, with the financial help of Hillary Clinton and Barack Obama, also managed to fund and deliver weapons to al-Qaeda and ISIS operations in Libya, Syria, and Iraq.

President Trump tweeted Thursday that since there’s no evidence of collusion in the Russia case yet, investigators are trying to “go for” obstruction of justice.

“They made up a phony collusion with the Russians story, found zero proof, so now they go for obstruction of justice. Nice,” he tweeted.

“You are witnessing the single greatest WITCH HUNT in American political history - led by some very bad and conflicted people! #MAGA,” Mr. Trumpcontinued.

Since we'll before November's election the rhetoric coming from the left has been laced with words of violent connotation. With Hillary's humiliation at the polls the connotations have become implications and justifications that have now become escalations from assaults with fists and baseball bats to the use of firearms with murderous intent.

Yesterday's shooting did not occur in a vacuum. From Kathy Griffin's stunningly callous photo shoot to the completely unveiled call for the assassination of the President in New York's Theater in the Park presentation, the provocation curve has moved into the near vertical. What did they think was going to happen?

I have not the slightest doubt that an exploration of the internet history of yesterday's would be assassin will reveal his having visited numerous sites displaying the most overt calls to bloody violence.  How then are Hodgkinson's actions any different from that of some domestic Jihadist, radicalized by the internet or his local Imam? It is the simplest and most obvious of parallels but don't expect the MSM or any Democrat to acknowledge its clearly exists.

I have lived in China, Thailand, Mexico, Cambodia, and Vietnam, and have traveled in some fifty other countries. All shared what might be called the core values of civilization. Blacks seem not to. Yes, many exceptions, varied degrees, but as a culture, they were, are, different. Would that it were not true, but it is.

Curiously, what made me give up all interest in the problems of blacks was not their virulent racism, the horrendous rates of crime, or the parasitism. Instead it was the assaults by blacks and their fellow travelers on Confederate monuments, particularly in New Orleans. Similarly, the banning of the Confederate battle flag at Gettysburg, for God’s sake. For reasons doubtless opaque to the historically ignorant, this annoys me.  Why should the least productive, most criminal, most dependent of the population rewrite history that in any event they don’t know? The erasure of the South and the Confederacy by people most of whom couldn’t spell it, of Washington and Jefferson and Lee by grifters, race hustlers,  wanton illiterates and the Brownshirts of Black Lives Matter…enough.

How many think this but won’t say it?

George Orwell said, “The most effective way to destroy people is to deny and obliterate their own understanding of their history.” In the former USSR, censorship, rewriting of history and eliminating undesirable people became part of Soviets’ effort to ensure that the correct ideological and political spin was put on their history. Deviation from official propaganda was punished by confinement in labor camps and execution.

Today there are efforts to rewrite history in the U.S., albeit the punishment is not so draconian as that in the Soviet Union. New Orleans Mayor Mitch Landrieu had a Confederate Gen. Robert E. Lee monument removed last month. Former Memphis Mayor A C Wharton wanted the statue of Confederate Lt. Gen. Nathan Bedford Forrest, as well as the graves of Forrest and his wife, removed from the city park. In Richmond, Virginia, there have been calls for the removal of the Monument Avenue statues of Confederate President Jefferson Davis and Gens. Robert E. Lee, Stonewall Jackson and J.E.B. Stuart. It’s not only Confederate statues that have come under attack. Just by having the name of a Confederate, such as J.E.B. Stuart High School in Falls Church, Virginia, brings up calls for a name change. These history rewriters have enjoyed nearly total success in getting the Confederate flag removed from state capitol grounds and other public places.

The Bernie Sanders supporter who tried to kill numerous GOP lawmakers did not commit his violent acts in a vacuum. James Hodgkinson may have pulled the trigger that critically wounded House Majority Whip Steve Scalise and 2 others. But the hysterical threats of violence against Republicans and President Trump could not have escaped his notice.

Hodgkinson was a regular viewer of Rachel Maddow's MSNBC show and worshipped Bernie Sanders. There is little doubt that someone so immersed in left wing politics could have failed to hear the calls for blood and violence against Republicans.
