A Lawless Government

I remember when a suspect was regarded as innocent until proven guilty in a fair trial. Today prosecutors convict their victims in the media in order to make an unbiased jury impossible and thereby coerce a plea bargain that saves the prosecutor from having to prove his case. In the United States law is no longer a shield of the people. Law is a weapon in the hands of prosecutors. (See Roberts & Stratton, The Tyranny of Good Intentions.)

Formerly, if a prosecutor staged an arrest for publicity purposes, as Mueller did by placing a CNN presstitute on the scene and sending a couple of dozen heavily armed men in a pre-dawn raid to arrest a well known political consultant for allegedly “lying to Congress” when the appropriate procedure is for Mueller to inform Stone’s lawyer to present his client for indictment, the judge would throw out the case on the grounds that the prosecutor’s unethical action had biased the juror pool and made a fair trial impossible. The judge might also have thrown out the case on the grounds of selective prosecution. James Clapper while serving as Director of National Intelligence lied to Congress under oath and suffered no consequences, and Hillary Clinton has clearly broken the law and lied about it.

A top Pentagon official testified before Congress on Tuesday President Donald Trump would not have to declare a state of emergency in order to direct the Defense Department to erect barriers at the U.S. border with Mexico.

GOP Rep. Vicky Hartzler of Missouri raised the matter with Under Secretary of Defense for Policy John Rood during his appearance before the House Armed Services Committee.

She pointed to Title 10, Section 284 of the U.S. Code, which authorizes the DOD to provide support for counter-drug operations, if requested by the appropriate federal and state authorities, CNSNews reported.

Among other provisions, the law allows for the “construction of roads and fences and installation of lighting to block drug smuggling corridors across international boundaries of the United States.”

Woke Poet Triggered by ‘Blackface’ Photo of Dusty Coal Miners Drinking Beer

                                               Hi, I'm a blithering idiot.
However, very few people seemed to agree with Thomas’ self-regarding view of the greater good. His op-ed was almost universally mocked on Twitter, where conservative commentators called it “incredibly stupid,” “dumb,” and “insane.”
Some readers were offended on behalf of coal miners, while others wondered if the article was a parody.

A racially conscious young writer has spoken out against a photograph of soot-covered miners that he recently saw in an Arizona restaurant, saying it reminded him of blackface.

In an op-ed about the harrowing experience published in The Arizona Republic, Rashaad Thomas said the black-and-white photo ― apparently from World War I-era United Kingdom ― made him feel threatened as an African-American.

VA unveils proposal to expand private health care for veterans

The proposal released by the Department of Veterans Affair could potentially make more than a million more veterans eligible for private health care than under current rules.

“Most Americans can already choose the health care providers that they trust, and President Trump promised that veterans would be able to do the same,” VA Secretary Robert Wilkie said in a statement Wednesday. “With VA’s new access standards, the future of the VA health care system will lie in the hands of veterans — exactly where it should be.”

The proposal released Wednesday seeks to implement the VA Mission Act, which Congress passed in June and which Trump has touted as a signature legislative achievement.

The final rules are expected to be published this coming June.

The firing on Fort Sumter gave Lincoln what he and other Yankee/Marxist radicals in the North wanted–and up-front reason to call for volunteers to mobilize and prepare to invade the South.

Many current “historians” seek to whitewash Lincoln for his usurpation of civil liberties and for the statist bent his administration took on. What they don’t realize is that the Lincoln administration started the push against civil liberties that we see going on even under Trump today. It was never reversed after Lincoln, but rather grew into the federal Leviathan we see in our own day.

If there was no legitimate reason for the arrest and handcuffing of this presumed innocent defendant, what was the illegitimate reason? The illegitimate purpose of the arrest was to intimidate the potential witness -- namely Stone -- into not invoking his constitutional right to remain silent, rather than to testify as a government witness.

As Judge T.S. Ellis, III, who presided over the Manafort trial observed: "You don't really care about Mr. Manafort's bank fraud – what you really care about is what information Mr. Manafort could give you that would reflect on Mr. Trump or lead to his prosecution or impeachment."

The ACLU has been absolutely silent in regard to the questionable tactics employed by Mueller. They, too, would have been up in arms had these tactics been employed against their favorite candidate and mine, Hillary Clinton. Their silence speaks volumes about their partisanship and lack of neutral standards of civil liberties.

Congress must act to prevent these abuses from recurring.

Four California Planned Parenthood affiliates have been ordered by a Federal Magistrate Judge to answer written questions related to hard costs associated with their fetal tissue trade.

Federal Magistrate Donna M. Ryu ordered the Planned Parenthood affiliates on January 24, 2019, to give an explanation of their denial that the amount of money they received on a per-specimen basis did not exceed their hard costs.  Planned Parenthood was further ordered to produce the written response within seven days.

Federal law prohibits the sale of aborted baby body parts “for valuable consideration,” but allows for reimbursement of hard costs incurred by the abortion businesses.

Feb. 15 matters because it is the last day in Washington, D.C., for Congress before they go home. Not only the freshman members, but most members of Congress will have to face their constituents. Yes, some of them may take congressional delegation trips, but their staffs will still be in the district offices. Activists on both sides will activate and advocate. This was a smart move on the administration’s part because whatever happens between the Feb. 5 State of the Union address and Feb. 15 will get back to the local level when Congress goes home. 

Both of these should matter to every American. Security is about our internal protection and the death of socialism in Venezuela could be a bigger tragedy that spreads beyond its borders.

Shutdown showdown détente 

The longest partial government shutdown in our history is over. We are back to the process that needs to be carried out and 15 days from now we will have the next seminal moment.

Some will say that the president caved, others will say that the Speaker of the House and the Democrats won and some will say that the president won. Somewhere betwixt all of the narratives is just reality.

High School Students Disqualified From Debate After Quoting Ben Shapiro, Jordan Peterson


A pair of Utah high school seniors lost a debate round because they read quotes from Daily Wire Editor-in-Chief Ben Shapiro and clinical psychologist Dr. Jordan Peterson, who were deemed “white supremacists” by the judge.


Layton High School senior Michael Moreno and his debate partner, whom The Daily Wire will not name, were participating in a round with a topic relating to immigration. The specific topic of the round was “Resolved: The United States Federal Government should substantially reduce restrictions on legal immigration.” Moreno and his partner were arguing in the negative, meaning they were arguing against the other team’s plan to reduce restrictions on legal immigration.

Pardoned ranchers who inspired Oregon occupation win back grazing permits: BLM reissues permits to Dwight and Steven Hammond

Dwight and Steven Hammond’s journey from ranchers to convicted domestic terrorists back to ranchers concluded this week when the federal government reissued permits allowing the father and son to graze cattle again on public land.

A Bureau of Land Management spokesman confirmed Tuesday that the agency had reinstated grazing permits for Hammond Ranches in Harney County, Oregon, who received full pardons from President Trump in July.

The Hammonds were sentenced to five-year mandatory minimum sentences in 2015 under the Antiterrorism and Effective Death Penalty Act for two prescribed burns that spread to public land, a sentence that stoked outrage in the rural West.

Public Lands Council president Bob Skinner and National Cattlemen’s Beef Association president Kevin Kester called the reinstated permits “the final step in righting the egregious injustices the Hammonds faced.”

Italian Secret Service: People-smugglers may arrange mass drowning to garner Western sympathy

According to Italian newspaper Il Giornale, the Italian secret services are warning of the possibility of people-smugglers purposely causing a disaster at sea in order to garner sympathy from the West and resume the flow of migration.

Such a move could be a repeat of other major humanitarian disasters such as a shipwreck which killed around 700 migrants on April 18th, 2015, and led to the commencement of Operation Sophia and an outpouring of support for migrant ferry NGOs operating in the Mediterranean Sea.

Seriously, though, this question comes up a lot in the age of Bernie Sanders and Alexandria Ocasio-Cortez. Many younger people seem to think democratic socialism means all the liberty and prosperity we enjoy today, plus a bunch of free stuff. Indoctrinated young people are led to believe that the only changes in their lives under socialism would be the addition of free college, free health care, lots of public housing, guaranteed pensions, and generous welfare programs. Sweden, Germany, and Norway are the oft-cited examples of the benefits of a welfare state.

The Southern Critique of Centralization

 
The Southern political tradition, in practice and theory, is one of its most valuable contributions to America and the world. The one constant theme of that tradition from 1776–through Jefferson, Madison, John Taylor, St George Tucker, Abel Upshur, John C. Calhoun, the Nashville Agrarians, Richard Weaver, M. E. Bradford, down to the scholars of the Abbeville Institute–is a systematic critique of centralization. Nothing comparable to it exists elsewhere in America or in Europe.

A criticism of centralization presupposes that decentralization is a good thing. But why is that? The answer is complex and requires viewing what was happened in 1776 from a trans Atlantic perspective. The Declaration of Independence is merely the American version of a conflict that had been going on in Europe since at least the 17th century between the emerging centralized  modern state and a revived interest in  the classical republican tradition which goes back to the ancient Greeks.

On Friday Roger Stone, a political consultant who in 2016 publicly supported the Trump campaign, was arrested on criminal charges filed by special counsel Robert Mueller. He has since been released on bail. Stone is indicted (pdf) in five cases for making false statements, one attempt of influencing a witness and an obstruction of a proceeding.
Since May 2017 the former FBI chief Mueller investigates an alleged collusion between Trump, his campaign and something Russian with regards to the 2016 election. No evidence has been produced so far that substantiate any such collusion. The people who fanatically claim that there must have been such a connection are now disappointed. The long awaited Stone indictment was one of their last straws. But there is absolutely nothing in it that hints at any collusion.

Stonewall lay dying of his wounds at Chancellorsville — “the most successful movement of my life,” he murmured, and then remembered to give full credit to God. “I feel His hand led me.” He had smashed Fighting Joe Hooker and 134,000 invaders of Virginia with 60,000 Confederates. Jackson didn’t mention General Robert E. Lee who was with the reserves that battle.

Eight days would pass from the night of May 2, 1863, when a Confederate volley ironically struck Jackson down, until his beloved physician, Dr. Hunter Holmes McGuire, his ear close to the General’s lips, made out the unforgettable words, “Let us cross the river and rest in the shade of the trees.” The length of the death watch gave ample time for soldiers’ talk of battle, death and wartime politics. Much of it took place around Jackson’s shattered body which had been moved by litter and wagon-ambulance, often under Yankee artillery barrage, through mountain terrain to Guiney’s station some forty-five miles from Richmond. Somebody mentioned the then pending resolution before the Confederate government to designate Jackson’s original command as the Stonewall Brigade, wholly unprecedented in military orders.

Teflon Intellects: Impenetrability leading to war


Call me Quixotic – I I keep attempting to engage them in discussion; I know, it’s like banging your head against an Adamantium wall but hope springs eternal.  If, looking more and more like when, the balloon goes up and it’s time for “I do not talk with liberals; they are only for killing” I want to be able to look at myself in the mirror honestly to say I tried my damnedest to prevent it with words.

But they’re not making it easy.  They are the anointed; as aptly described by Dr. Thomas Sowell in his book The Vision of the Anointed: Self-Congratulation as a Basis for Social Policy, they’re utterly immune to facts, reason, logic, and evidence that contradict their vision of the world and how it should be.  (I’m almost done with this phenomenal book and I can’t recommend it strongly enough; every page has notes, underlines, and comments that I’ve written in the hopes that my children will read this book and not only see things that I believe are important – but come to understand their father better.)

Coupled with this is a seething arrogance.  Consider this quote, pulled from the comments here (warning, gag alert if you go there) and just imagine the mindset of this person; do you think they even view Conservatives as human, because it's doubtful:

The greatest service that Donald Trump has rendered these United States is to have exposed the many ailments of which he is a symptom but not a cause. We had political division and cultural alienation before him. We had overbearing government and an imperial executive branch before him. We had media that were arrogant, parochial, and impenitent before him, too. Alas, they have grown yet worse since he arrived.

How the media fail

Our national press is a national joke. Vain, languid, excitable, morbid, duplicitous, cheap, insular, mawkish, and possessed of a chronic self-obsession that would have made Dorian Gray blush, it rambles around the United States in neon pants, demanding congratulation for its travails. Not since Florence Foster Jenkins have Americans been treated to such an excruciating example of self-delusion. The most vocal among the press corps’ ranks cast themselves openly as “firefighters” when, at worst, they are pyromaniacs and, at best, they are obsequious asbestos salesmen. “You never get it right, do you?” Sybil Fawlty told Basil in Fawlty Towers. “You’re either crawling all over them licking their boots or spitting poison at them like some Benzedrine puff adder.” There is a great deal of space between apologist and bête noire. In the newsrooms of America, that space is empty.

The 3-year-old boy who spent two days lost in the woods of eastern North Carolina tells his family he “hung out with a bear” for companionship while hundreds of people searched frantically in cold and rainy weather to find him. His aunt, Breanna Hathaway, shared that revelation on Facebook Friday morning, adding that Casey “is healthy, smiling, and talking” after being found late Thursday night. The post has gotten more than 500 comments and 2,100 shares through the day. Said he hung out with a bear for two days,” she posted. “God sent him a friend to keep him safe. God is (a) good God. Miracles do happen.”

The other thing ignored here and possibly on the authors elephant in the room list, its that all these government dept's are not government but subcontracted out roles to the private sector through agencies/quangos, they are corporatons and not the goverment which would make them civil servants - not employees. It is a huge fundemental difference like oil and water. Most of the staff at congress or the white house or the military are civil servants so this idea that they are furloghed government workers has to go, they are not entitiled to a role, they are contracted out roles which as shown are largely unnecessary, i.e. the coast guard has taken away a role better done by the US navy, or the state one level down the pyramid of power is already operating a similar function. What is thier real role, well it is to concentrate power and authroity under one federal body in Washington DC so as to run an empire planned just before US independence by the sons of Liberty, it is not to serve, it is to rule. And the US has always been a corporation beginning with the General Land Office which took over roles done by the department of the treasury. This concentration of power was what sparked off the US civil war.

Longtime Republican U.S. Rep. Walter Jones, who hasn’t voted in Congress since September, is in hospice care, his office reported Saturday.

 In a statement, the office said Jones’ health has declined since he broke his hip last week. Jones was sworn in for his 13th term this month by Rep. G.K. Butterfield, a Wilson Democrat, at Jones’ home in Farmville.

LET'S be honest. He's scared of the thing. That's understandable--so am I. But as a girl I have the luxury of being able to admit it. I don't have to masquerade squeamishness as grand principle-in the interest of mankind, no less.

A man does. He has to say things like "One Taniqua Hall is one too many," as a New York radio talk show host did in referring to the 9-year old New York girl who was accidentally shot last year by her 12-year old cousin playing with his uncle's gun. But the truth is he desperately needs Taniqua Hall, just like he needs as many Columbines and Santees as can be mustered, until they spell an end to the Second Amendment. And not for the benefit of the masses, but for the benefit of his self-esteem.

He often accuses men with guns of "compensating for something."

Though opposed to Lincoln’s violations of the Constitution in his war against the American South, Northern Democrats saw the need to crush secession, which was a manifestation of the Tenth Amendment and inherent right of the people of a State to withdraw from a federal compact to which they conditionally assented. Those Northern Democrats did not see that due to the vast differences between the sections by 1861, peaceful separation was the only logical solution for the Southern people to pursue free, representative government. Connecticut Senator William C. Fowler (below) was born in 1793, during Washington’s presidency – living long enough to see the end of Washington’s Union.

“Expressing opposition to secession, [Northerners Clement] Vallandigham, [Samuel S.] Cox, [Stephen D.] Carpenter, and Fowler maintained that they desired not an independent Confederacy but simply a restoration of the “Constitution as it is” and the “Union as it was.” They declared they were in favor of a constitutional war to crush secession, but they charged that Lincoln was waging a battle for the conquest and subjugation of the South and that he was conducting it in a despotic fashion, subverting the constitutional liberties of individuals and the rights of States.

Opposing military conscription, they also criticized the suspension of the writ of habeas corpus and declared that freedom of speech had been abolished in the Union.

In particular, they attacked Lincoln’s policy of emancipation. Spurning the argument that emancipation was a legitimate measure adopted to aid the prosecution of the war, they pictured it as an unconstitutional act by which the President had changed the war aims of the North from the preservation of the Union to abolition of slavery.

“If,” said Fowler in the Connecticut State Senate in 1864, “the President should avow the fact that he has violated the Constitution, in order to save the Union, as the President did in a letter to Mr. Hodge, let us say to him “out of thine own mouth will I judge thee, thou wicked servant.”

The peace advocates placed special blame for war upon the abolitionists of the North, stating repeatedly that it was not the institution of slavery but the agitation of the slavery question by the abolitionists that had caused hostilities.

For the immediate outbreak of fighting, the three Midwesterners placed responsibility upon Lincoln and the Republicans because of their refusal to compromise with Southerners in the crisis of 1860-1861.”

Acton and Lee: A Conversation on Liberty

Editor’s Note: It is interesting to note that Lord Acton corresponded with General Robert E. Lee after the conclusion of the American Civil War. Sympathetic to the Confederate cause, Lord Acton considered America’s Constitution as imperfect and “saw in State Rights the only availing check upon the absolutism of the sovereign will.” In his letter of November 4, 1866, Lord Acton told General Lee that “secession filled me with hope, not as the destruction but as the redemption of Democracy,” and expressed his belief that General Lee had been “fighting the battles of our liberty, our progress, and our civilization.”

General Lee, who had taken a loyalty oath to the United States in October of 1865 (his pardon would not be granted for more than a century), and who had been an opponent of secession prior to the war, responded in a letter a few weeks later that he “considered the preservation of the constitutional power of the General Government to be the foundation of our peace and safety at home and abroad.” But General Lee added he believed “the maintenance of the rights and authority reserved to the states and to the people, not only essential to the adjustment and balance of the general system, but the safeguard to the continuance of a free government.”

The two men—the English, Catholic historian and champion of political liberty, and the American, Episcopal warrior and opponent of the dangers of political “consolidation”—indeed shared much in common in terms of their views on liberty. Their full correspondence is reproduced below.

How the Shutdown Shows Us Exactly Where to Start Cutting Government

Problem: Do you have any idea how many areas of your life involve the government?Now all these areas, that you didn’t even know the government was involved in, are affected by the shutdown!

Mainstream solution: Re-open government, and continue to leave all these sectors vulnerable to the incompetence and maliciousness of government.

Actual solution: GET THE GOVERNMENT THE HELL OUT OF THE ECONOMY!

Over a month of the “shutdown” and now they have agreed to reopen temporarily. Oh boy, that means we get all the terrible government we pay for back in our lives.

Until February 15th at least.

Then government workers can go back to the food bank lines or–gasp–find private sector jobs!
