Cato Institute Declares States Are Not Sovereign

The New York Times published on September 3, 2013 and article written by Robert Levy, chairman of the Cato Institute, on the “Limitations of Nullification”. I have had the honor of having personal discussions with Mr. Levy on several issues and even had the opportunity to debate him on the issue of nullification in a forum in South Florida. It will be no surprise to Mr. Levy that I disagree with his opinion. Opinions aside, I would like to have the opportunity to present the facts.

Mr. Levy’s main premise is that the States have the option to not agree and not enforce federal law, but they do not have the ability to prevent the federal government from enforcing its laws within the States.

“That’s because federal officials are authorized to enforce their own laws, even if they cannot compel the states to do so. Thus, on the second point, the nullifiers are wrong: states cannot impede federal enforcement of a federal law merely because the state deems it unconstitutional. That is up to the federal courts.”

Mr. Levy’s premise is flawed and a mere review of the facts makes that clear. This country was built upon the foundation of free, independent, and sovereign States.

Navy Yard: Swat team 'stood down' at mass shooting scene

 Investigators continue to work the scene at the Navy Yard two days after a gunman killed 12 people on 16 September 2013

One of the first teams of heavily armed police to respond to Monday's shooting in Washington DC was ordered to stand down by superiors, the BBC can reveal.

A tactical response team of the Capitol Police, a force that guards the US Capitol complex, was told to leave the scene by a supervisor instead of aiding municipal officers.

The Capitol Police department has launched a review into the matter.

Aaron Alexis, 34, killed 12 people at the Washington Navy Yard.

"I don't think it's a far stretch to say that some lives may have been saved if we were allowed to intervene," a Capitol Police source familiar with the incident told the BBC.

A former Navy reservist, Alexis was working as a technical contractor for the Navy and had a valid pass and security clearance allowing him entry to the highly secure building in south-east Washington DC.

About 8:15 local time (12:15 GMT), Alexis entered Building 197, headquarters for Naval Sea Systems Command, which builds and maintains ships and submarines for the Navy, and opened fire.

Armed with a shotgun and a pistol he took from a guard he had shot, he sprayed bullets down a hallway and fired from a balcony down on to workers in an atrium.

He fired on police officers who eventually stormed the building, and was later killed in the shootout.
Multiple sources in the Capitol Police department have told the BBC that its highly trained and heavily armed four-man Containment and Emergency Response Team (Cert) was near the Navy Yard when the initial report of an active shooter came in about 8:20 local time.

The officers, wearing full tactical gear and armed with HK-416 assault weapons, arrived outside Building 197 a few minutes later, an official with knowledge of the incident told the BBC.

Walgreens to send employees to private insurance exchange with a foreword by Michael

 Walgreen Co. is working with benefits adminstrator Aon Hewitt to offer its employees a private health insurance exchange. Walgreens will subsidize the insurance, but employees must shop among 25 plans from five providers and join those plans as individual customers.

OK, probably no big surprise here as companies large and small are looking to bail out on providing medical care insurance for their employees. We have looked at it very closely for my company. It could be beneficial for employees who are eligible for government sponsored subsidies to help pay for their insurance. Be very careful of a catch 22 no one is talking about. If your company drops their insurance but they make a payment to the employee that helps pay for them to purchase insurance on the exchange our insurance adviser says that can and will be interpreted as a company subsidized insurance plan and the employees will no longer be eligible for government subsidies.
If a company offers any type of insurance plan the employees can go to the exchange instead but they will not be eligible for government subsidies based upon income. If your employer pays you an increase after dropping their company plan but stipulates that it is to help with purchase of insurance on the exchange you very likely will not be eligible for any subsidy based upon your income. These subsidies will come as tax credits as it has been explained to me. If, as we plan to just increase the employees pay with a monthly bonus not specified for insurance they can spend it as they like and go without insurance.
As we get closer to the deadline for those small businesses that will be under these mandates it is very obvious basically no one knows what is going to happen. So far last report was that only Blue Cross had even signed up for the NC exchange so there goes choice and competition. Hang on the ride to single payer dot.gov insurance has begun and the insurance companies know it and have made peace with making all the money they can before they become extinct.

Instead, those employees will be given a set amount of money to shop for their own insurance on a private health insurance exchange run by benefits consultant Aon Hewitt.

Immediately in the wake of the latest firearms tragedy, this time at the Washington Navy Yard, we quite predictably get another wave of urban leftists and political hacks who want to blame conservative states for their gun violence problems.

Those other states haven't supplied anything.  INDIVIDUAL CRIMINALS made straw purchases (itself an illegal act) and then either themselves or in concert with other INDIVIDUAL CRIMINALS carried them into California and other states to supply them to another set of INDIVIDUAL CRIMINALS.  INDIVIDUALS committed these crimes, not the states of Virginia or North Carolina or any other, INDIVIDUALS.  It's not the states of Arizona or Oklahoma that are committing daily drive by shootings on the streets of Chicago or Detroit or Los Angles.  It's INDIVIDUALS.

It's exactly like as with prohibition. Where there is a will there is a way.  If the idiot left succeeds in imposing their utopian gun ban fantasy on an unwilling public They won't have to contend with semi-automatic AR15s and 9mm Glocks in the hands of registered owners, but fully automatic unregistered and illegal Sten Guns and Metral submachine guns that any competent machinist and sheet metal worker can make by the dozen.  All the plans are available on line and there a millions of surplus machine tools available for little more than a song.  Not to mention all the unemployed industrial workers that would love to make a few extra  bucks turning them out.

Robbery suspect shot and killed by store owner, two suspects at large

A spokesperson for the Beaumont Police Department has identified a robbery suspect who was shot and killed during an armed robbery in Beaumont's north end Tuesday evening.  Sgt Rob Flores identifies the deceased as Duayne Smith, 25, of Port Arthur.

Police continue to look for two other suspects.

The robbery happened just after 9 p.m. at a game room located in the 3600 block of East Lucas Drive in north Beaumont.

The owner of the game room told officers that three men tried to rob him at gunpoint as he and his mother were leaving the business for the night. Sometime during the robbery attempt, the owner got his handgun and exchanged gunfire with the robbery suspects. After the exchange of gunfire, all three suspects fled on foot.

When officers arrived, they found Smith approximately 100 feet from the game room. He was dead and appeared to have been struck by a bullet in the exchange of gunfire. The game room owner was not injured during the robbery attempt.

Sequestration did not cut the US budget at all. It merely cut back on planned increases in the budget in the future. If Congress and the President had simply agreed on a spending freeze, that would have been a much more significant step to begin to restore faith in US financial governance and the economy.

But even though the sequester “cuts” are so insignificant, they are still painful to people who believe in, sell, and depend upon “omnipotent government.” In the Republican Party there are those who want no practical limits on future increases on military spending. As Patrick Buchanan pointed out recently, Lindsey Graham is promising a war on Iran, and is ready to make sure the President has the power to wage it without needing to go to Congress to approve it.

“On Fox’s ‘Huckabee’ Sunday, Lindsey laid out his scheme: ‘I’m going to get a bipartisan coalition together. We’re going to put together a use-of-force resolution, allowing our country to use military force … to stop the Iranian nuclear program. … I’m going to need your help, Mike, and the help of Americans and friends of Israel.’ … On Nov. 10, 2010, Graham let it all out: ‘Instead of a surgical strike on their nuclear infrastructure, I think we’re to the point now that you have to really neuter the regime’s ability to wage war against us and our allies. … [We must] destroy the ability of the regime to strike back.’ Graham wants us to do to Iran what President Bush II did to Iraq.”

Delanco, New Jersey, volunteer fire crews rushed to the burning meat warehouse on Sunday and discovered the roof was covered in solar panels, forcing firefighters to change tactics. It took 29 hours to put out the flames at the Dietz & Watson warehouse, which was left gutted and smoldering in ruins.
"Do I think we'd have had a different outcome if we could get on the roof? Sure," Delanco Deputy Fire Chief Robert Hubler said.

Last week Barack Obama was ready to attack Syria.

This week he says he’s ready to attack Iran.

How do I put this delicately?

Barack Obama is unfit to lead any military attack by the U.S. – even one designed to deprive Iran of nuclear weapons that, ultimately, may be used against us.

Why do I say this?

Let’s start with the fact that Obama has stripped the U.S. military of its readiness to conduct even an itsy-bitsy, gratuitous, show-of-force campaign as his top aides, in a moment of candor, described what they had in mind for Syria. There are grave doubts being expressed by defense experts in Congress to support what I am saying. The worst thing the U.S. could ever do is what Jimmy Carter did in his effort to rescue hostages being held in Iran – fail miserably because of equipment problems, poor planning and political indecisiveness.

If we ever do attack Iran, the outcome must be well-considered, decisive and effective. Those three prerequisites do not belong in the same sentence as the name Barack Obama.

“{From] the time of the arrival of the [Northern occupation] until the end of the war period, public school teachers, regardless of their political complexion, were shabbily treated in New Orleans.  The system of annual examinations and elections was especially vicious, since it meant that appointments were based not on the qualifications of the teacher but . . . on her contacts with officials in charge of hiring.  She was also expected to evince more than the ordinary brand of [Northern] patriotism and to lead the way in suggesting new means of displaying it among her classes.

So onerous did this responsibility become that the Picayune charged in the fall of 1864 that the “good of the scholar is quite subordinate to that of the teacher, and especially to that of the politician, to whom she is an instrument or an associate . . . Parrots themselves, they produce parrots . . . “

Early in 1863, the board of visitors of the First District passed a resolution requiring the “singing of the National airs in our schools and the inculcation of Union sentiment by the teachers.”  Faced with these conditions, it is small wonder that many New Orleans parents chose not to send their children to school at all.  Others, who could afford it, sent their children to one of the city’s 140 private schools. 

As early as September 1862, Butler’s official newspaper suggested that teachers in private schools should be “required, not only to take the oath of allegiance to the United States, but to give bonds – and heavy ones, neither to encourage or permit the expression of sentiments unfriendly to the United States government in the schools under their charge.”

[Butler’s successor Gen. Nathaniel Banks] employed a staff of “special police,” . . . [for] ferreting out “seditious nests” among the private schools.  On May 8, 1863, the special police descended without warning on several of the most fashionable girls’ schools in the city, jubilantly discovered a few freehand sketches of the Rebel flag in schoolgirl copybooks, and promptly haled the schoolmistress into the Provost Court.
The Era, Bank’s official organ, expressed great satisfaction over the arrests and sentences and congratulated the chief of police on his “bringing to light the evils prevailing in these treasonable nurseries . . . “  [The] following week, the special officers descended upon the school kept by Mrs. Morrison, “an elderly lady” and a registered enemy scheduled to leave the city on May 15, [and] the judge imposed a $200 fine which she could not pay.  

Two weeks later, a Federal officer . . . noticed some boys walking around rather than under a Union flag nearby.  At his suggestion, the special officer conducted a search of [their Jesuit] school and again uncovered Confederate flags in some of the student copybooks. 

[On July 13, 1864, Banks] appointed a commission to “visit, examine, and report upon the . . . character of the teachers of all private schools . . .  [One member found] that many of the schools had been “gotten up” within the last two years . . . with a design of keeping the children from what is vulgarly termed Yankee influence.”  By the time they had gotten around to all 140 private schools . . . the members had obtained what they considered to by a shocking picture of the low condition of patriotism in these institutions.  Fewer than half the schools visited were eligible for a clean bill of health as unquestionably loyal. 

In fifty of the schools, “loyalty” was specifically not taught . . . Asked if they would object to the United States flags flying above their desks, eleven had answered emphatically that they would; fifty-three ignored the question. 

[In the Negro schools of New Orleans], the pupils ranged in age from six to eighteen, with a few adults, and were described by a Northern officer who visited their classrooms as neater than the Northern Irish “whose social status somewhat compares with that of the Southern Negro.” 

In the fall of 1864, B. Rush Plumley wrote Banks successor, General Stephen A. Hurlbut, charging Isaac G. Hubbs, superintendent of the Missionary Society schools and financial officer of the Board of Education for Freedmen, with embezzlement of Board funds as well as indiscretions with one or more of his teachers.”

Investigators working for Scripps Media have interviewed a former employee for a provider of free phone service, sometimes known as Obamaphones, who admits to forging signatures on applications.

A two-part video report by Scripps was further confirmed by National Review Online in a story published Monday. In the following story, former TerraCom, Inc. employee Reggie Strode describes how he, and other TerraCom employees, would routinely sign forms on behalf of new customers. Strode earned $3 for each new sign-up while TerraCom earned $9 a month per individual.

America clings to $85bn lifeline, Fed keeps stimulus

In an unexpected move, the Federal Reserve decided not to put the brakes on its easy money policy, and will keep bond purchases at $85 billion per month.

Chairman Ben Bernanke said at the press conference after the meeting that there is “no fixed schedule” or “magic number” for when the Federal Reserve will begin to slow or end its bond purchases.

The decision reached at the end of Wednesday’s two-day meeting of the Federal Open Market Committee (FOMC) came out of the blue, as Chairman Ben Bernanke gave strong hints in August and July that the Fed would decide to begin tapering its stimulus. 

“We expect them to finish tapering in March, in time for the unemployment rate to fall below 7 percent," Societe General currency strategist Kit Juckles wrote in a note to clients.

Less than a decade ago, Miami's inner city was mangy. The tropical city could have become the next Detroit.

When businesses, law firms, and government offices downtown closed, few people remained in its seedy core, fleeing to suburban Miami-Dade and Broward counties for their gated, manicured subdivisions and soccer fields, or to the glamorous nightlife across the causeway in sleek South Beach.

But that's all changed. Miami is booming again. Construction cranes dot the skyline as a new wave of baby boomers, international residents, and businesses converge on the city.

Call it the tale of two cities: Detroit sought to fix its urban blight with high taxes, heavy regulation, and big salaries and pensions for government employees.

Much of the credit for the transformation of Miami falls to the city's mayor, Tomas Regalado, who decided to take his city on the opposite path, one of lower taxes and economic growth.

Regalado, a Republican born in Havana, Cuba, was elected mayor in 2009 and soon after, set out on an ambitious path of improving city finances, cutting taxes, and welcoming new businesses with a regulation overhaul.

He is running for re-election this November.

  • GOP goes all-in on ‘de-fund ObamaCare,’ as shutdown looms


    House Speaker John Boehner, in an abrupt turnaround, plans to let Tea Party lawmakers have a vote on de-funding ObamaCare as part of a politically risky strategy which Democrats warn could result in a government shutdown.  
    GOP leaders unveiled their plan to members on Wednesday morning, teeing up a vote for Friday -- the proposed bill would tie the vote to de-fund the health care law to a vote on a stopgap spending bill. Current funding for the government is set to expire at the end of the month, and lawmakers must approve the stopgap bill in order to keep Washington open; conservatives see this as leverage to force a suspension of ObamaCare.

    "The law's a trainwreck," Boehner said of the Affordable Care Act. "It's time to protect American families from this unworkable law."

    Richard Wolffe, executive editor of MSNBC.com, has a new book out on Obama’s 2012 campaign called "The Message," and it’s delighting Ed Schultz.

    One of the findings was this, as Schultz read out loud on his radio show on Monday: “When Obama conducted an outreach effort to the Left, he had to put up with a tirade from Ed Schultz and had to hunt for a phone number to New York Times editorial page editor Andrew Rosenthal.” Schultz did not remember the “tirade,” but enjoyed that Obama was paying attention to him:

    SCHULTZ: You mean, the president was paying attention to my commentary and it was something during the campaign that he didn't like so he picked up the phone and called the New York Times and tried to get after it, get after it with Andrew Rosenthal, so, I don't know anything about this. I don't know, maybe they had thin skins over there at the White House.

    Gun Control’s Dead End: The Left, if it’s honest, will find no reason for a new push for gun control in yesterday’s tragedy.

     

    Now that the terrifying confusion has abated and the wildly varying reports have been collated into some sort of consensus, we are able to review what happened yesterday at Washington, D.C.’s Navy Yard with a dispassionate and critical eye. Doing so reveals that it is once again time for the friends of liberty to be blunt and to be forceful in the face of what will inevitably come. So resolved, let us lay down this marker: Those claiming that yesterday’s abomination demonstrates the need for stricter gun control are lying, or else they are ignorant, and, either way, they should be ashamed of themselves.     This Three Minute Commercial Puts Full-Length Hollywood Films to Shame

    The Thai telecommunications conglomerate True is getting rave reviews worldwide for its latest spot, "Giving," which tells the story of a man unexpectedly rewarded for a lifetime of good deeds he performed without expecting anything in return.

    Navy shooter complained of 'white racism'

     

    The establishment media is reporting that authorities cannot identify a clear motive in the Washington Navy Yard shooting that left 12 victims dead.

    WJLA-TV in Washington, D.C., reported that a motive remained unknown and Fox News said that Washington Mayor Vincent Gray confirmed there was still no motive for the shootings and no indication of terrorism, “although we haven’t ruled that out.”

    CNN said there was “no specific reason” given for what spurred the violent attack that left nine whites, two blacks and an Indian man dead.

    But at the bottom of NBC’s report are details of how the suspect, Aaron Alexis, 34, was “not happy with America” and wrestled with another festering issue.

    “He felt a lot of discrimination and racism with white people especially,” Kristi Suthamtewkal told the reporter.

    She also said that Alexis had felt like he had been cheated out of money from the contract under which he had worked and complained that he was mistreated because he was black.

    Colin Flaherty, who has documented hundreds of cases of black-on-white violence in recent years in his book “White Girl Bleed A Lot: The Return of Racial Violence to America and How the Media Ignore It,” said it’s not surprising that a facet such as antipathy over race would be overlooked or played down.

    The media told us a self-appointed neighborhood watch captain and wannabe cop with gun-derived courage was on patrol when he profiled a young child because he was black and wearing a hoodie, and that he stalked and gunned down the helpless youth out of sheer malicious bloodlust. The media trumpeted that theme so loudly that most of America believed it. When the killer was acquitted, there was national and even international outrage. It was a bandwagon made for anti-gunners to leap on, from the Brady Organization to the White House, and they jumped on it with more feet than a nest of spiders.

    The trouble was, it wasn't like that at all. George Zimmerman had been named head of the watch group by his own neighbors. While he had considered a career in criminal justice and taken some classwork in that area, he had also been offered a quasi-police patrol car and uniform by the police department that coordinated with the Neighborhood Watch, and had turned it down. Zimmerman wasn't "on patrol" in his private vehicle on that proverbial dark and rainy night; the evidence showed he was simply driving to a Target store to buy some lunch makings for work that week.

    The public school officials behind this reveal by their choices of visits that the real agenda here is to make these Tennessee students "accepting of the other," because that is the whole problem of jihad terrorism, doncha know -- if Americans were more accepting of Muslims and Islam, jihad terror would be a thing of the past. There are so many initiatives like this, such as the Arkansas school that planned to feature a Muslim speaker on September 11, that it is hard to escape the conclusion that they really believe this nonsense.

    Democrats Act to Stop Vitter Amendment, Keep Obamacare Exemptions for Congress

    Democratic leaders increased their efforts on Tuesday to turn aside an amendment sponsored by Republican U.S. Senator David Vitter of Louisiana, that would prevent Congressional members and staffers from receiving exemptions from key Obamacare measures.

    When Congress passed the sweeping Patient Protection and Affordable Care Act in 2010, Congressional members and their staff were exempted from several provisions of the law.

    The Vitter amendment would change that and require the president and vice president to participate in mandated healthcare exchanges and would eliminate federal employer contributions for health benefits for the president, vice president, members of Congress, and political appointees.

    The amendment also would block tax credits for assistance in buying insurance on the exchanges for these individuals.

    The Office of Personnel Management issued a directive, allowing staff to be eligible for subsidies for the coverage they currently have, which will pay for the majority of their healthcare insurance. Lawmakers were not included.

    Democrats who passed the law are firing back at Vitter and his supporters.

     I recently had the following exchange on the McClatchy news site with a California leftist anti-gun zealot.  She became up set apparently when I said that if she lived next door to me I'd put up a sign declaring that my home was protected by a legal, trained and proficient fire arms owner but that my neighbor's was not and that I further promised not to use my legally owned weapons to protect them no matter how loud they screamed.  She responded by saying that if she were my neighbor she would seek to unleash any and all possible means of legal harassment upon me.  I then asked if she would then get as obnoxious with the police (name calling and other such verbal abuse) as she does with anyone with whom she disagrees on the board, when they told her to stop filing false reports.  I further asked her to let me know if she could as I would like to set up bleachers and sell refreshments to watch the show that would be created by her confrontation with a bunch of cops who were as emotionally stunted as she is.

    “Our culture is changing drastically,” Lt. General Jerry Boykin (Ret.) told WND, and it was clear he did not mean it was Obama’s “change you can believe in.”

    “There’s a paradigm shift in America where, if you are an outspoken, open, Christian, you are now being labeled as not only a hate-monger, but also as a potential threat to U.S. security, as is evidenced by any number of documents that have come out in the last number of years, one of which came out of the Department of Homeland Security,” the war hero explained.

    He was, in part, referring to documents influenced by the Southern Poverty Law Center, or SPLC, “that identified the Founding Fathers as the kind of ‘radicals’ that we should be watching out for today.”

    Boykin’s full list of accomplishments in service to his country is too long to detail, but it includes serving as an original member of the U.S. Army’s Delta Force, commanding all the Army’s Green Berets and doing stints at the CIA and as deputy undersecretary of intelligence at the Department of Defense.

    And now he has found himself facing an adversary here in the homeland, one that is also capable of bloodshed: the radical left.

    Last spring, as networks like MSNBC launched five months of saturation coverage intended to force gun control on the American people, we said, over and over and over and over again, that there was (tragically) “another Adam Lanza” sitting out there, glued to his TV screen, and planning his own five months of fame.”

    As it became clear that Congress was not going to pass gun control in April, MSNBC commentators said, almost wistfully, that it would take another mass shooting to reinvigorate their cause.

    Well, they got the mass shooting they were looking for.

    On Monday, a discharged Navy enlisted man entered a “heavily secure” Naval installation in Washington D.C. and engaged in a series of firefights, which ultimately left 12 others dead.

    As the liberal media exploits this new set of victims to resurrect its war on guns, we will say again: “There are one or more creeps like Aaron Alexis watching your coverage and planning their own time on your network. And, when they strike, the blood, once again, will be on your hands.”

    Although we don’t know all the details, we can make several observations:

    * First, once again, the shooting occurred in a gun-free zone, filled with ID checks and metal detectors that everyone erroneously assumed would save them.

    * Second, the shooting occurred in a jurisdiction, Washington D.C., which has been rabid in its efforts to take guns away from its own citizens -- and to make it illegal for Washingtonians to defend themselves.

    *Third, lest there be any question, Congress has banned the possession of any “firearm or other dangerous weapon in a Federal facility” [18 USC, Sec. 930].  Hence, they all but advertised to Alexis, that, with the exception of security, everyone in the Naval facility would be sitting ducks.

    In sum, the shooting occurred in a jurisdiction where the firearm was illegal and in a building where firearms are illegal.  Other than banning firearms nationally, how many more illegalities do anti-gunners intend to pile on?

    Banning guns and imposing background checks won’t stop these creeps, but armed good guys will.  Remember that the Oregon shooter last December stole his AR-15 before killing two people at the Clackamas mall.  But he retreated when he saw Nick Meli, who holds a concealed carry permit, draw his gun and point it at him.  The killer then retreated and took his own life.

    Given that putting guns in good people’s hands will save lives, why are law-abiding personnel being disarmed here on military bases?  How ironic that when CNN’s John Roberts asked a military spouse if she was anxious about her husband being deployed to Afghanistan (in 2009), she responded:  “At least he’s safe there and he can fire back, right?”

    Efforts will be made to scapegoat Virginia for this most recent tragedy. But, not coincidentally, Alexis did not attack a Virginia locale where potential victims could defend themselves with guns.

    ACTION:  Contact your senators and representative. Let them know that, despite the efforts of the liberal media to milk this tragedy for political gain, the problem is not the Second Amendment. The problem is anti-gun laws and policies.
