Rep. Mike McCaul (R-Tex) and Rep. Sheila Jackson Lee (D-Tex) have introduced legislation that would:
- require DHS to regularly report on the status of operational control of the U.S. Borders, which will be verified by the GAO;
- require DHS to submit a plan to gain operational control (90% effectiveness rate) of the high traffic areas of the southwest border within 5 years, including the implementation plan and various metrics which will be reported on by the GAO; and
- require DHS to submit a plan to implement a biometric exit system at ports of entry. If the Secretary determines such a plan is not feasible, he or she may submit an alternative plan to achieve the same level of security.
- the Secure Fence Act of 2006 says the DHS Secretary "shall take all actions the Secretary determines necessary and appropriate to achieve and maintain operational control over the entire international land and maritime borders of the United States."
- the Secure Fence Act of 2006 instructs the DHS Secretary to gain operational control of the border and stop all illegal entries.
- the 2004 Intelligence Reform and Terrorism Prevention Act and the 2007 9/11 Commission Implementation Act mandated implementation of a biometric entry/exit system at all ports of entry.
