The McCorkill Legacy: Can Bequests be Overturned for Ideological Reasons?

Can you bequeath your money to whomever you like? Until last May, that might have seemed a silly question.

However, the enemies of free speech are nothing if not determined and we are living, it seems, in Absurdistan. Last May, the Southern Poverty Law Center, a well-funded rabidly anti-free speech group in the U.S., learned that a retired New Brunswick Professor Robert McCorkill had left his estate to the U.S.-based National Alliance. The SPLC raised the usual howls about “neo-Nazis” and “White supremacists”. Richard Warman, a pal of the SPLC, fumed that such a bequest was contrary to “public policy.” 


Although the will had been probated, a long estranged sister emerged and obtained an injunction until an application to overturn the will could be heard. Almost overnight, three more parties piled into the fray to try to hijack the will – the Centre for Israel and Jewish Affairs (successor to the Canadian Jewish Congress), the League for Human Rights of B’nai Brith, and the Attorney General of New Brunswick. All sang the same tune: the NA was “racist”; 

Canada’s public policy is against “racism” (well, except for its 110% support of Israel as a Jewish state) and, therefore, the NA shouldn’t receive the bequest.

  1. The only question at issue is, "is the will legally binding and properly settled"?

    The SPLC is trying to get a court verdict on, "can we interpose our own will for that of the deceased". If the answer is "yes", then the courts are declairing all wills invalid and subject to the arbitrary judgements of the court for the disposition of property, without any law to bind them.

  2. This used to be a common occurance where lawyers, probators, and other parasites would bleed an estate dry before permitting the heirs to take hold of it. That is why we have modern probate law to restrict how much the courts can influence the outcome.

  3. Obviously, this decision based upon "public policy" is bogus
    and would effect and affect the "property rights" of all both
    in Canada and even in the USA, thereby. They interfere in
    every aspect of sovereign peoples lives. If any racist soul should
    leave monies or property to the NAACP, ADL, or SPLC, all hate
    groups which border on terrorists, then the same consequences
    should apply. These groups promote violence against Whites.

  4. They can't stand the truth. White nationalists, who recognize the truth about racial differences, actually handicapped by being in the right?

    I would suggest that they are. And I’m not simply referring to the hostile media, which celebrate charlatans like Stephen Jay Gould and persecute truthful men like James Watson. We have to ask: why has a strategy of lies and deceit been so successful in politics? Because they're morons.
