A friend of mine who works for the FBI sent me this last night, he said the
"discussion at work" was about this and whether or not it would apply to the
confederate flag considering it was in all actuality an "American" flag. This
came up during a discussion and no one in the room even knew this was in the
law.

(Good question, but say it doesn't apply to the Battle Flag, then it should apply to the Bonnie Blue et al. although irrelevant since they are abused everyday without arrests. (a)(1) Whoever knowingly mutilates, defaces,
physically defiles, burns, maintains on the floor or ground, or tramples
upon any flag of the United States shall be fined under this title or
imprisoned for not more than one year, or both.
(2) This subsection does not prohibit any conduct consisting of the disposal of a flag when it has become worn or soiled.
(b) As used in this section, the term “flag of
the United States” means any flag of the United States, or any part
thereof, made of any substance, of any size, in a form that is commonly
displayed.

It begs the argument "Federal" vs "Confederate". The Confederacy had its own constitution, its own national flag and its own borders. For all intents and purposes, the Confederate States of America was a different country than the Federal USA.

Agreed as far as the first, second and third. The Battle Flag wasn't a nation's flag and neither was the Boonie Blue as well as many others such as the Cherokee Braves one.
