The Supreme Court heard the oral arguments Wednesday in Dobbs v. Jackson’s Women’s Health Organization.
This case has the potential to overturn the Court’s precedential cases Roe v. Wade and Planned Parenthood v. Casey, which say that women have the right to abort their babies up to about 24 weeks of pregnancy.
Mississippi law bans nearly all abortions after 15 weeks of pregnancy. The case heard this week challenges that law.

At the Founding, ther was a debate about the "Bill of Rights". On onehand was the argument that listing rights protected some rights and degraded any others. On theother, listing the most obvious rights protected them from government interference. The result was a warning that the listing of some rights did not negate other rights which are held by the People.
ReplyDeleteSome would say that since, pregnancy is the single most dangerous condition that most women will face, the right to abortion [not available at the time of the Founding] would be covered by "Life, Liberty and the Pursuit of Happiness". While "abortion" is not specifically mentioned, it probably qualifies under the generic category of "rights, not specified".
There are lots of expansions in rights that have been accepted. "Freedom of the Press" has been extended to the internet, television, etc. "Freedom of Speech" has been extended to the internet, telephone, television, etc. There are thus, many things that have been accepted although they are not specifically mentioned in the Constitution, as it is read literally. A narrow reading of the "text" of that document only gets you so far. "Privacy" is an unfortunate choice of language, but it is somewhat better than, "nun yer bizness". A narrow, "textural" reading of the Constitution is for fools and politicians.
The definition of "Life" and "personhood" beginning at birth is rather traditional since that event was obvious to the eye. Ultrasonograms, embryology and electronics have allowed us greater awareness of the events that happen during pregnancy. A "heartbeat" is a poor standard when the heart is just another organ that can be stopped for surgery or transplanted to another person.
Using "abortion" as a form of "birth control" is brutal and dangerous for the woman, but really still her choice and that of her physician. The definition of "life" is one of religion and philosophy. The Constitution was written to protect the different choices that come from different religions & philosophies. "Nun yer bizness".
