Judge Slaps Down Eric Holder's Request For Fast and Furious Lawsuit to be Dismissed

Late Monday night, U.S. District Court Judge Amy Berman Jackson denied a Department of Justice request to dismiss a lawsuit filed by the House Oversight Committee last summer over Operation Fast and Furious documents.
“In the Court's view endorsing the proposition that the executive may assert an unreviewable right to withhold materials from the legislature would offend the Constitution more than undertaking to resolve the specific dispute that has been presented here,” Jackson wrote in her ruling. "Neither legal nor prudential considerations support the dismissal of this action, the defendant’s motion to dismiss the action will be denied."

Would-be burglar in Colorado Springs tackled by soldier
VERBATIM
A home burglar trying to make off with an Army rucksack in a garage was tackled by the sack’s owner — a soldier — held at gunpoint by a neighbor and then hogtied by the soldier before Colorado Springs police arrived.
The incident happened at 6 p.m. in the 3900 block of Leah Heights, in southeast Colorado Springs. Michael J. Wright, 35, was arrested on suspicion of burglary and theft.
Witnesses described the soldier as chasing the burglar, jumping on his back and then putting him in a headlock. A female neighbor held a gun on the burglar while the soldier tied him. When police arrived, they found other stolen items on the burglar, said Sgt. Jim Jeffcoat with the Colorado Springs Police Department.

If Reid Forces Gov’t Shutdown, Ted Cruz Will Donate Salary to Charity
Sen. Ted Cruz plans to donate his salary to charity for each day Harry Reid forces a government shutdown. “Elected leaders should not be treated better than the American people, which is precisely why hardworking Americans deserve the same Obamacare exception that President Obama has already granted Members of Congress,” he said in a statement.
With just a few hours left on the clock, a government shutdown is looking all but certain. Cruz discussed on the Kudlow Report tonight how Reid’s refusal to compromise has brought the country to this point, and why he plans to donate his salary for each day of a shutdown.
