Judicial Activism

 Judicial Activism

President Trump and Chief Justice Roberts have recently had a much publicized feud about judicial activism by judges in the Federal Court System and the Supreme Court.  It is the opinion of Chief Justice Roberts that the Federal Court System including SCOTUS is apolitical and that decisions are based on constitutional law and not on the political beliefs and agenda of the judges.

After viewing the senate confirmation process for Supreme Court justices in recent years, it is very difficult to agree with Roberts

  1. Well, the District Of Criminals has recreational Cannabis. Maybe El Jefe Roberts is just trying to show that he leads the highest court in the land.

  2. It's nothing like a feud. Robert's is doing what he should be doing, reinforcing the public faith in the courts as if his job depends on it... because it does. Add in his natural desire for the courts to actually be that way and his personal conduct of being above partisan politics and you get a rousing defense of the independent judiciary. Despite very visible evidence to the contrary. But a few tweets here and there are not a "fued".

    In light of SCOTUS dictates/mandates such as the erasure of community standards on pornography, the gross restrictions on prayer, forced integration, abortion, homosexual "marriage", and a whole plethora of others that stand as a painful reminder of just how drunk with power many in the judiciary are these days, leaves one to ponder if Roberts should be removed from the court for incompetence, dishonesty, or ineptitude. Of course after his blatant violation of his oath before God and country, when he re-wrote Obamacare, it's no wonder his arrogance leaves him blinded to the abuses most others can easily see.


    My issue with Roberts pales in light of the unwillingness of the other 2 branches of government to utilize their powers to reign in an out of control judiciary. The only thing more repugnant is their willingness to surrender their power to the judicial branch emboldening the bullies who reside there.


    President Trump's capitulation on immigration as well as restrictions on travel form failed states is a prime example. The Constitution and laws are clearly on his side yet he yields his powers to the courts as if he were a child who needed permission. He should have taken the stand of President Jackson and ignored the overreach.

    Either that or simply issued an "executive order" telling the courts he forbids them to rule on his decisions. Then when they scream and holler about HIS lack of authority he could sit back and say..."exactly my point."
