More on Roberts

I hate to disagree with Rick Oliver, but I think he is too optimistic about John Roberts. What Roberts' decision today tells us is that he is unlikely to ever cast a decisive vote against the consensus of the Washington elite. This means that the Roberts court will never overturn Roe v. Wade, because such a decision would create even more controversy than overturning Obamacare would have. And it also means that Roberts is unlikely to resist the strong political pressure that exists in elite circles to create a constitutional right to gay marriage.

  1. The left only supports the High Court when it expands government like it did yesterday. Citing the governments broad taxing power without citing where in the constitution the power to mandate by taxation is enumerated, is the final straw. It's been written that Roberts pulled this ruling out of his ass to save the institution, he has instead destroyed any reason conservatives may have had to protect it. It's said that conservatives don't politicize the nomination process because of their respect for the judicial process and it's importance to impartial justice. Well that process failed "The People" by creating a new and open ended path to power leading God only knows where once the left realizes what a gift they've been given. The "crazy" notion Newt had about hauling the justices before congress every time they make a constitution crushing ruling is looking pretty good right now. Congratulations Justice Roberts you have removed any incentive conservatives had for supporting the idea of an impartial, non-partisan court.

    He would have only been angry if something happened that wasn't scheduled like below. Makes perfect sense.

    the dissent refers to another opinion as "the dissent" and uses the pronoun "we," as if speaking for the Court, as majority opinions typically do. In addition, the dissent focuses on the government's arguments, rather than tackling the majority head-on. That suggests that a switch--most likely by the Chief Justice himself--may have come very late in the game, too late to offer more than the most cursory revisions of the opinions in the case.

  3. You are not going to get good fruit from a corrupt tree. This time the "blame Bush" line really applies. The only hope is that for Romney he can shake off the advisors that will try to control him. I don't know how many people really think Obama is making the decisions. And it was obvious to everyone that Cheney was controlling Bush.
