NC: Illegal Aliens Bill

"House Bill 786 (Reclaim NC Act), has some very good enforcement measures that will go a long way towards decreasing the overall numbers of illegal aliens in NC. That was the original intent of the bill. But somewhere along the way, certain sections were included that completely override those measures and will lead to an INCREASE in the numbers of illegal aliens in NC, defeating the whole purpose of the bill.
 
Section VIII (f)
This section creates a new exception to North Carolina’s E-Verify requirement. It excludes from the definition of an employee, an individual whose term of employment is customarily affected by the seasonality of the industry in which the individual is employed, or less than year round. In other words, employers need not verify the immigration status of anyone who works less than one year. In other words, as long as an individual takes at least one unpaid day off per year, the employer is exempt from e verifying that person. A BIG loophole that will add to the illegal alien population. No fear of prosecution or being reported to ICE.
 
Section VIII (h)
This section creates an exception to enforcement of North Carolina’s E-Verify requirement if an employee possesses a restricted driver’s permit or restricted identification card. The exception swallows the rule and eviscerates North Carolina’s E-Verify law.  Indeed, as the new restricted driver’s permit and restricted identification card are accessible to any illegal alien who resided in the State as of April 1, 2013, North Carolina’s entire current illegal alien population and those who employ them would be exempt from the penalties contained in its E-Verify law. Another BIG loophole that will add to the illegal alien population. Again, no fear of prosecution or being reported to ICE.
 
Section IX (all)
This section will allow almost all illegal aliens in North Carolina to get a legal NC driver's permit and/or ID card. Since this permit or ID card will not be accepted in any other state as a valid form of ID (due to the Real ID Act), illegal aliens who receive them, will be inclined to remain in NC or face prosecution or being reported to ICE by other states.
 
H786 actually helps illegal immigrants drive to and keep jobs, that belong to North Carolinian citizens (85% of illegals do not work in the “stoop farm labor” sector).  Shouldn’t we make it easier for unemployed citizens to get jobs, instead of individuals who don’t even belong here?
 
Let's put this bill back on its' original track, to reduce the overall population of illegal aliens in NC.
 
Unless the Brody amendment (section VIII) and the Blust amendment (section IX) are adopted, we are asking you, on behalf of NC citizens, to vote NO on H786.
 
The people are only asking for a fair chance to return to work, nothing more. The special interest groups are asking for all sorts of exceptions to the law. It’s just not right."
