FBI to probe fatal beating by Kern County deputies

The FBI launched an investigation Tuesday into the death of a man who was beaten by authorities amid questions over whether officials tampered with cellphone videos confiscated from witnesses.

Kern County Sheriff Donny Youngblood said he asked the FBI to get involved after learning that one of two phones seized from witnesses had no footage on it.

Two witnesses told The Times that they watched the videos on each of the phones last week in the wake of David Silva's death. The case is generating widespread attention because several witnesses have come forward to say deputies ruthlessly beat Silva with batons on the head, even after he was motionless on the ground.

"Our credibility is at stake here," Youngblood said in an interview. He did not dispute the witnesses' accounts about the videos but said he would not draw any conclusions until the investigations were complete.

The phones were flown to the FBI's Sacramento office Tuesday for analysis.

NC: B Corporation: (“B”) ENDING BUSINESS IN THE LEGISLATURE

Below is a letter to the Editor that I just sent to our local paper.  If any of my readers are in North Carolina, please take this information and contact your State Representatives and Senators.

To all of my business friends in Gaston County, you are about to be squashed by the General Assembly in Raleigh if you don’t step up and stop them.

There is a legislation making the rounds in the committees that sets up C Corporations and S Corporations for a big fall.  The legislation is enacting something called the “B Corporation.”  This is a supposedly “new” corporate designation that sets up a “different” model for doing business.  Why do we need that?  We don’t.  But “B Corporation” has deep pockets and expensive lobbyists who are selling this to our legislature with all sorts of cool sounding propaganda; like giving out tax breaks for “B Corporations” who use low flow toilets, or hire enough diverse minorities, or upfit their buildings to be “green,” or sell “green” products, or …just about anything that the B Corporation folks think satisfies their own agenda or criteria.

The “B Corporation” website states the idea is to give companies a “new” way of capitalizing on doing “social good,” such as Social Justice and Environmental Justice.  We already have environmental laws, social programs, and a legal structure that is supposed to provide for equal protection.  The “B Corporation” would create yet another system of regulations affecting whether or not your company is allowed to operate on a capitalist model of profit making.  According to “B Corporation,” the profit motive is greed, therefore, you must conduct your business for “the social and environmental good.”  According to “B Corporation,” doing business as a capitalist provides NO social or environmental good.”  How do you like that, Mr. or Ms. Businessperson? Your business is just not measuring up!  Nope.  You just aren’t “good” enough.

IRS Requested Reading Materials – Tea Party Organizer Sent The Constitution

For anyone who doubts what Tea Party Patriots stand for take the case of 68-year-old Marion Bower of Ohio. Bower dealt with the frustration of a two year long process to get tax-exempt status for her group “American Patriots against Government Excess.”  She stated, “We thought it would be a simple process. It was not a simple process,” in an interview with ABC News.

When asked for books and other reading materials, she sent the IRS a copy of a Cleon Skousen book entitled “The Five Thousand Year Leap” and a copy of The Constitution. That a girl Marion!

Six Kern County sheriff's deputies and a sergeant, who last week were involved in a violent confrontation with a man who was struck numerous times with batons before he died, have returned to their regular jobs, officials said Tuesday.

David Sal Silva, 33, a father of four, was pronounced dead  Wednesday less than an hour after eyewitnesses reported seeing several deputies repeatedly strike the man in the head with batons as he lay on the pavement.

Deputies had responded to a report of an intoxicated man. In addition to the deputies and sergeant, two California Highway Patrol officers were involved in the incident.

Raymond Pruitt, a Kern County Sheriff's Office spokesman, said the deputies and the sergeant present during the fatal incident last week "have been released to full duty."

The department has identified those involved as deputies Ryan Greer, Tanner Miller, Jeffrey Kelly, Luis Almanza, Brian Brock, David Stephens and Sgt. Douglas Sword.

Moses Waddel’s school at Lillington, South Carolina “was a simple frontier academy of the period which taught grammar, syntax, antiques of Greece and Rome, geography of the ancients, Greek and Latin.  Waddel’s graduates included many governors and future statesmen to include John C. Calhoun, William H. Crawford, Hugh S. Legare, A.B. Longstreet, James L.  Petigru, George Crawford, Preston Brooks, Thomas W. Cobb, Pierce M. Butler, and George R. Gilmer.  It was later said of Waddel’s reason for taking the presidency of the University of Georgia was first to “raise the University and give it a respectability and usefulness in the State; and second, to communicate to public education the spirit of Christianity.”

Public Education and the Spirit of Christianity:

“In an article printed in the Atlantic Monthly, November, 1929, Count Hermann Keyserling expressed the belief that the South is the only section of America where a real culture can be produced. Only in this region have complete individuals lived.  Here and only here can a uniqueness, an individuality which leads to a development of complete souls, flourish.

Writing in a similar vein John Crowe Ransom, a Nashville poet, says, “The South is unique on this continent for having founded and defended a culture which was according to European principles of culture; and the European principles had better look to the South if they are to be perpetuated in this country.”

The same point of view characterizes a symposium entitled “I’ll Take My Stand, by Twelve Southerners,” which has lately been published by Harpers. In the field of education these thinkers criticize our public schools, and desire a return to the ante-bellum system of formal training. Indeed, a great glorification of the academy, which was the most characteristic school of the pre-war South, is presented. With the lapse of the educational system of the Colonial Period…

“the South found a means of transmitting to its own people the essential of a good classical education, by the growth of an institution that never, to the same degree, affected the North. This institution was the academy.  It was by its means and operation that the older Southern life and culture became what it was, and remained until the catastrophe of 1861-5…..The academies solved the problem of the gap between the mere acquisition of mere knowledge and the “acquisition of power for independent work” by putting the pupils into direct contact, not with undisputed masses of information and up-to-date apparatus, but with such teachers as could be found.

Their object was to teach nothing that the teacher himself had not mastered, and could not convey to his pupils. Their training was therefore classical and humanistic, rather than scientific and technical – as most of the available teachers were products of the older European and American schools.”

In America the academy was a “product of the frontier period of national development and the laisse faire theory of government.” Frequently it was motivated by “denominational interest and sectarian pride.”  In the South the academies were of two types, the modest local institution which was sometimes called the “old field school,” and the more pretentious, more permanent school with a wider patronage. While fees were commonly charged, the academies were democratic in character, and usually the idea of individual development was dominant. Generally speaking the schools served the educational needs of the entire community.”

Amnesty Bill is a Massive Multi-Million Dollar Fraud

Via Mike

By Alan Caruba printed in Tribune Papers (North Carolina), May 9, 2013

Native-born and naturalized Americans who are currently seeking work are already competing with illegal immigrants—a term that the Associated Press says it will no longer use—or standing in line behind them as they sign up for all manner of welfare benefits. The official estimate of the number of illegal aliens—oops, undocumented aliens—in the nation is estimated to be eleven million, but if the “Gang of Eight” amnesty bill becomes law, it will act as a magnet to attract millions more.

As Roy Beck, the founder and president of NumbersUSA, points out, “If Congress passes the Senate Gang of Eight bill, it would be like re-creating ALL of the Top 20 cities in the United States, filling them entirely with foreign citizens and giving them lifetime work permits to compete with America’s struggling workers—in just ten years’ time.”

NumbersUSA analysts spent two weeks reading the 844-page bill, concluding that 33 million lifetime work permits would be given to foreign citizens in the first decade if the bill passes. A revised bill has 867 pages and, according to a Daily Caller article, “contains 999 references to waivers, exemptions, and political discretion”, more even than Obamacare.

That’s a lot of competition for jobs and it will hit those graduating from high school and college the hardest. Right now, the youth unemployment rate for 18-29 year olds is 11.7% and, among them, the African-American cohort’s rate it 20.1% and Hispanics’ rate is 12.6%. An additional 1.7 million young adults are not counted as “unemployed” because they are not in the labor force, meaning that they have given up looking for work due to lack of jobs. Do we really want to add millions of formerly illegal immigrants to the work force at this time?

The Center for Immigration Studies also analyzed the Gang of Eight amnesty bill and discovered that it is essentially a Get Out of Jail card:

The report, by Ronald Mortensen, a Fellow at the Center for Immigration Studies, shows that the token penalties, when they do exist, are not commensurate with the employment-related felonies committed by the majority of illegal aliens, nor are they commensurate with the benefits received by illegal aliens.

Just as unfortunate is the fact that millions of victims of these crimes are ignored while the amnestied illegals are rewarded and even benefit from the so-called penalties, as the monies actually go into a fund that provides services to the very people who paid the "penalties".

“Illegal aliens will be rewarded for breaking laws for which American citizens are routinely punished," said Mark Krikorian, Executive Director of the Center for Immigration Studies. "For example, an American citizen would face a maximum penalty of ten years in prison and fines of up to $250,000 for using a fraudulent Social Security card, but under this bill the illegal alien would face a $1,000 penalty covering all his many offenses, a penalty which in many cases will be waived. Then, they would be issued a new Social Security number without any past bad credit or arrest records.”

View the full report at:
http://cis.org/immigration-reform-amnesty-illegal-aliens-and-their-employers

Dr. Mortensen discovered the following amnesties for illegal aliens and their employers:

Amnesty for the estimated 75 percent of illegal aliens committing Social Security fraud.

Amnesty from returning to home countries for 10 years before adjusting status.

Amnesty for illegal aliens committing Identity theft.

Amnesty for illegal aliens by officially authorizing them to continue committing identity theft by using fraudulently obtained Social Security numbers belonging to American citizens.

Amnesty for illegal aliens who have committed perjury on I-9 forms.

De-Facto amnesty from the token $1,000 penalty, since it effectively pre-pays services provided to illegal aliens.

Amnesty from existing exclusion, deportation, and removal orders:

While illegal aliens would be granted amnesty for crimes they have committed, government employees who discover Social Security fraud, identity theft, or perjury on I-9 forms while reviewing applications for provisional status would be prohibited from notifying victims, law enforcement, etc. with a threat of a $10,000 penalty. This is 10 times more than the $1,000 penalty paid by an illegal alien who has committed felony identity theft.

Amnesty for employers found to have employed illegal aliens or who are currently employing illegal aliens. Moreover, employers may continue to employ illegal aliens, accept fraudulent Social Security numbers, and renew falsified I-9 forms for those who apply for provisional status.

Amnesty for employers who did not withhold and/or submit payroll taxes for individuals illegally in the United States.

Amnesty for employers who violated labor laws by paying unfair wages, who failed to pay wages, etc.

Amnesty for employers who facilitated Social Security fraud and identity theft by providing or accepting false Social Security numbers.

While employers would be held harmless, government employees who find that employers violated the law while reviewing applications for temporary status would be prohibited from notifying the appropriate law enforcement authorities. If government employees do report tax or labor violations, they could face a fine of $10,000.

Thanks to the passage of Obamacare, the amnesty bill would increase the cost of the nationalized health care system. Betsy McCaughey, the lieutenant governor of New York from 1995 to 1998, in an April 29 letter in The Wall Street Journal, warned that “One looming cost is health care. Under the Obama health law, starting January 1, 2014 legal immigrants will be eligible for subsidized private health plans on the exchanges as soon as they arrive in the U.S.”

“The Senate Gang of Eight’s proposed bill will add $100 billion to the cost of Obamacare’s subsidies over the next decade by doubling the number of legal immigrants entering the country with green cards.” Ms. McCaughey noted that, in 2012, 484,072 immigrants entered that way. “The Gang of Eight plan will push it to about one million. About half of those green card holders will be eligible for the maximum assistance with premiums, subsidies and copays, totaling $9,000 per person, and more than 80% will qualify for at least some taxpayer-funded Obamacare subsidy.”

Little known or reported is the fact that the Schumer-Rubio bill includes two “slush funds” amounting to $150 million that would be used to fund groups like La Raza and the American Immigration Lawyers Association with taxpayer money.

The prevailing wisdom is that the amnesty bill will create more Democrat than Republican voters and that is precisely its purpose. Its victims will be every native-born and naturalized citizen paying taxes and trying to cope with a healthcare system that will be on life-support soon enough.

The proposed bill is a massive multi-million fraud. If it passes and is signed into law, the further destruction of America will be accelerated

Obama classmate audited 2 years ago now 'vindicated'

As Attorney General Eric Holder orders an investigation of the Internal Revenue Service after a top official admitted targeting conservative groups with extra scrutiny, an outspoken critic of Obama who claimed more than half a year ago that the administration was using the IRS to punish him is feeling vindicated.

“I feel like a million bucks. I feel absolutely vindicated. I knew this was going on,” Wayne Allyn Root told WND.

Root, the Libertarian Party vice-presidential candidate in 2008 who has claimed Obama was strangely unknown to him and his fellow Columbia University classmates, recounted his story to WND last October of becoming the target of unusual audits, beginning in January 2011, despite a “spotless” 30-year tax record.

He charged in October that the order to audit him came from Obama himself, and he is even more convinced now.

“I believe this is not rogue agents, who would be risking their pension and careers,” he said.
In October, Root said the order to audit him “must have come from the highest levels of government.”

“Obama is using the power of the IRS and other government agencies to punish his political opposition and intimidate and silence his critics,” Root charged at the time.

USA Today: IRS approved liberal groups while Tea Party in limbo

In February 2010, the Champaign Tea Party in Illinois received approval of its tax-exempt status from the IRS in 90 days, no questions asked.

That was the month before the Internal Revenue Service started singling out Tea Party groups for special treatment. There wouldn't be another Tea Party application approved for 27 months.

In that time, the IRS approved perhaps dozens of applications from similar liberal and progressive groups, a USA TODAY review of IRS data shows.

As applications from conservative groups sat in limbo, groups with liberal-sounding names had their applications approved in as little as nine months. With names including words like "Progress" or "Progressive," the liberal groups applied for the same tax status and were engaged in the same kinds of activities as the conservative groups. They included:

NOTABLES
  • ‘A LACK OF KNOWLEDGE’: Ineffective management at the Internal Revenue Service led to certain groups being singled out for more than 18 months based on their names or mission statements, according to a Treasury Inspector General report, ABC’s ABBY PHILLIP notes. IRS officials told IG investigators that their actions were not influenced by any outside officials or agencies. The use of inappropriate criteria to screen applicants resulted in significant delays for groups applying for tax exempt status, and also allowed unnecessary requests for information, the report found. “Criteria for selecting applications for the team of specialists should focus on the activities of the organizations and whether they fulfill the requirements of the law,” the IG report found. “Using the names or policy positions of organizations is not an appropriate basis for identifying applications for review by the team of specialists.” In addition, the report stated, “[T]he criteria developed showed a lack of knowledge in the Determinations Unit of what activities are allowed by I.R.C. § 501(c)(3) and I.R.C. § 501(c)(4) organizations.” http://abcn.ws/14nggMw ABC’s PIERRE THOMAS reported for “Good Morning America” on the FBI’s full-scale investigation of the IRS: http://abcn.ws/181ePoW
  • IRS PUSHES BACK: The IRS said in a statement that it “welcomes” the report and “agrees that aspects of the original approach for handling the influx of tax-exempt applications were inappropriate, but it is important to clarify a few points.” “Inappropriate shortcuts” were used to identify groups that might be engaged in political activity, the IRS statement admitted, but said most of the groups would likely have been examined the same way regardless of whether those “shortcuts” were used to identify them. “It is also important to understand that the group of centralized cases included organizations of all political views,” the IRS statement said.
  • WHITE HOUSE WEIGHS IN: “The report’s findings are intolerable and inexcusable,” President Obama said in a statement last night. “The federal government must conduct itself in a way that’s worthy of the public’s trust, and that’s especially true for the IRS.  The IRS must apply the law in a fair and impartial way, and its employees must act with utmost integrity.  This report shows that some of its employees failed that test.”
  • ‘A CULTURE OF ROTTENNESS’: In an interview with ABC’s JEFF ZELENY, Rep. Charles Boustany, R-La.,  the Ways and Means subcommittee chairman who is leading the first IRS Congressional hearing Friday commented on the Inspector General’s report. “At the very least it’s ineffective management,” Boustany said. “An egregious abuse has occurred…. we’re going to get to bottom of this.” He added, “This looks like a blatant abuse of power on the part of the IRS and suggests a culture of rottenness.”
