The Supreme Court ruled Monday that warrantless gun confiscation from Americans’ homes is unconstitutional, voting unanimously on the side of a Rhode Island man whose firearms were taken by law enforcement without a warrant after his wife expressed concerns that he might hurt himself.

According to Caniglia v Strom, a lower court had previously determined that police confiscating the guns without a warrant fell under the Fourth Amendment’s “community caretaking” exception, but a 9-0 vote from the nation’s top court struck down that ruling.

  2. At least the black robed pirates didn't rubber stamp the badgemonkey's criminality.....but it's been a LONG TIME since the criminals pinned to badges paid attention to the law or court rulings. They will continue to violate our rights without regard to this or similar rulings knowing full well that the majority of people they so violate simply lack the resources to oppose them in the corrupt courts and that on those rare occasions when someone IS capable of resisting their unconstitutional predations effectively NOTHING OF CONSEQUENCE will happen to them personally.

  4. Wow! This is pleasantly surprising, especially with a unanimous ruling which upholds the 4th and 5th Amendments and a landmark SCOTUS ruling in 1966, which also stated that "we have a right to remain silent". --Ron W

  5. After 40 years in law enforcement, I still don’t get it. State legislators wrote the red flag laws and most of the other nonsensical gun control legislation. They are absolutely and completely unconstitutional no matter how you twist it. Most law enforcement professionals want nothing to do with any of this nonsense, nor are they interested in taking guns from law abiding citizens. Administrators/ politicians know this. At their inception, specialized units were created to enforce these “orders” and seizures under the red flag laws, for obvious reasons.

    it’s not the police that created this nightmare. It’s the same people that forgot that they took an oath to support and defend the very constitution that they are twisting.
